Privacy Policy 

This Privacy Policy governs the manner in which SUMMERSET collects, uses, maintains and discloses information collected from users (each, a "User") of the https://summerset.lk/ website ("Site"). This privacy policy applies to the Site and all products and services offered by SUMMERSET. 

Personal identification information 

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, place an order, subscribe to the newsletter, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, phone number. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personal identification information, except that it may prevent them from engaging in certain Site related activities. Non-personal identification information We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information. Web browser cookies Our Site may use "cookies" to enhance User experience. User's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly. 

How we use collected information SUMMERSET may collect and use Users personal information for the following purposes: 

• To improve customer service 

Information you provide helps us respond to your customer service requests and support needs more efficiently. 

• To personalize user experience 

We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site. 

• To improve our Site 

We may use feedback you provide to improve our products and services. 

• To process payments 

We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service. 

• To send periodic emails 

We may use the email address to send User information and updates pertaining to their order. It may also be used to respond to their inquiries, questions, and/or other requests. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Site. 

Access, Rectification and Deletion of data 

In order to provide an option to resume the use of our services at a later date, we may retain personal data associated with inactive accounts for up to 24 months from the date of last activity on that account. Users with an active account may access, modify, rectify and delete personal information at any time through their account. Users without an active account may send an email to info@summerset.lk to request for access, rectification or deletion of their personal data. We may refuse to delete or modify your data if we need that data to protect our legal rights or to perform our legal obligations. 

Other rights 

In addition to the rights mentioned in the previous section, Users also have the right to restrict processing of their data, to object to processing of the data, as well as the right to data portability. We will cooperate with Users to fulfil these rights as far as possible. 

How we protect your information 

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site. 

Sharing your personal information 

We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.We may use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. Code of Ethics

This code of ethics sets professional standards and ethical values, which are set and must be complied by applicants, candidates and credential holders and abide to SUMMERSET requirements, standards and it’s governing policies at all times.

Integrity

The certified professionals shall pursue and sustain integrity, honour and prestige of the profession as well as of the SUMMERSET Awarding body, by complying with the these standards of work ethics.

Scope

SUMMERSET certified professionals shall hold and be accountable for main principals in during the conduct of their duties and professionally advise employers, clients, employees, the public and appropriate authorities, of any danger and unacceptable risks.

Competence and Objectivity

SUMMERSET certified professional must be impartial and fair and conduct his professional affairs with responsibility and integrity. Continuously maintain high standards of ethics, balanced care for the interests of the public, employers, clients, employees, colleagues and the profession itself. SUMMERSET certified professional must avoid to conduct or practice, which might likely lead to discrediting the profession, SUMMERSET Awarding Body or deceiving the public in any manner.

Professionalism

SUMMERSET certified professional shall pursue opportunities in services of civic affairs, working for development of the safety, health, security and other wellbeing of community, by sharing their obtained knowledge and skills. SUMMERSET certified professional shall only conduct practice in his/her educational field of expertise. As well as following up their professional development by maintaining their competence through further education, work experience, professional trainings and keeping up to date with current affairs of the profession.

Fairness

SUMMERSET certified professional shall always act as non-bias professional of their field and with the manner regardless to individual’s religion, ethnicity, gender, age, national origin, sexual orientation, or disability.

Support

SUMMERSET certified professional will always support fellow professionals and SUMMERSET, as the main driving force behind the progress in the professional environment. In addition, certified professional by SUMMERSET - will not collude, debase or discredit the SUMMERSET or the other fellow professionals.

 


Code of Conduct - Remote Classroom Participation

 

This code of conduct establishes guidelines for teaching and learning via remote environments, or any form of education that relies primarily on IT services. The term e- resources is used throughout the code to refer to any type of tool, resource, or platform that may be utilized for educational purposes.

 

For students

 

1. Remote classroom

  • Set up your own study space well in advance of a remote course lab or lecture. Make sure you are able to work quietly, in an environment where you can focuswithout being disturbed by family members or housemates.
  • Those who join via mobile phones must install the MS Teams app in advance and check relevant access to online classrooms without waiting until the last minute.
  • Be aware that you are on camera, use professional language when speakingduring remote lecturing sessions, and conduct yourself in a respectable manner, in line with face-to-face teaching – towards your peers and your teacher.
  • Comply with the rules your lecturer and institute will establish inside the online classroom, e.g. your audio/video settings and how to ask questions or interject during a live session.
  • Always try to attend live sessions rather referring to recordings of the program.

 

2. Communication outside of remote classrooms

  • Respect the methods and times established by your lecturer and institute for contact hours.
  • Abide by the aforementioned rule on professionalism in all electronic education-related communications.
  • Frequently check your WhatsApp, e-mail, MS Teams and other communication channels provided by your institute to stay up-to-date with any changes or new information shared with you by your lecturer or Institute at large.
  • Program Coordinators will be available to attend your inquiries during office hours. Do not phone them before or after office hours and do not expect them to attend your inquiries at the same time when they are off duty.
  • Students are allowed to create an unofficial WhatsApp group for the batch for general discussions and the official WhatsApp group should always remain for official chats (Only Admin matters) with high professionalism.

 

3. Accessibility

  • Make use of the software provided/recommended (MS Teams or Zoom) by institute to avoid technical issues.
  • It’s must to have access to a stable internet connection, and/or a desktop/laptop/mobile device on which you can attend sessions and hand in assignments.
  • Recorded classroom sessions will be available in the MS Teams classroom only up to 14 days from the date of class and after that it will automatically expire from the system.

 

4. Privacy & General Data Protection Regulation Compliance

  • It is prohibited to share documents and/or communication that are exclusive to the course with outsiders or third parties. It is prohibited to take screenshots of, or record any of the e-resources used within the course. The teacher may, however, choose to record sessions for students towatch remotely or to use for subsequent groups for educational purposes. The teacher will clearly announce it in advance if a session is recorded. The sessions will not be distributed to third parties outside the institute and will only be stored in and made accessible only through institute platforms.
  • Student will handle privacy issues responsibly.
  • Misbehavior over the phone among classroom member will be strictly prohibited.

 

5. Tips in order to avoid unnecessary pressure on the network

  • Do not send or circulate videos unless you yourself are thepresenter/lecturer.
  • You can turn off incoming videos to save bandwidth.
  • Turn off your microphone unless you are speaking. In meetings with multiple people, the lecturer may use the 'Mute All' button to enforcethis.
  • Do not use the background blur if it is not completely necessary.
  • Turn off your video unless it is necessary.

 

6. Acceptable behavior on Online platform - (MS Teams / Zoom/  WhatsApp / any other Communications channel)

  • Sharing ideas, images, videos, contents or messages which are not relevant subject is strictly prohibited.
  • Sharing negative messages or thoughts to mislead other students in the online platforms are strictly prohibited.
  • When asking a question during a live online class, please make sure to be specific to the relevant subject/make it short and do not disturb the online lecture until the lecturer allows you to raise the question once the lecturer finished explaining that topic, otherwise that will disturb the smoothness of the online lecturing process.

 

7. Students removal from online sessions and program

  • If any student violates or fails to maintain correct and acceptable behavior on given online platform or during an online classroom session that student will be immediately removed from all platforms until proper investigation takes place. Even after that if that student is found guilty on that matter, the student will be permanently removed from the class and program on those grounds and any payments which are paid to the institute will be non refundable.

 

8. Complaints & Suggestions

  • If any student has any suggestions and complaints about the program, lecturers and institute. You are free to mark it on our periodically evaluation sheet or else you can send it to admin@summerset.lk email address where we can take actions based on it and we consider that improveour quality of standards based on that inquires

 

Learner Appeals Policy

 

Introduction

This policy is aimed at learners who are enrolled on or have taken a SUMMERSET qualification, certification or unit.It sets out the process learners should follow when submitting appeals or re-mark requests to SUMMERSET and the process we will follow when responding to enquiries and appeals.It is also for use by SUMMERSET staff to ensure they deal with all appeals in a consistent manner

Training Provider’s Responsibility

All Training Providers are required to have their own appeals policies which the learner is entitled to request if they wish to make an appeal.It is important that staff involved in the management, training or assessment and quality assurance of SUMMERSET qualifications and/or certifications and learners are aware of the contents of this policy.

When can I appeal?

If a learner believes that SUMMERSET did not apply procedures properly, fairly or consistently in relation to the assessment decision; • If a learner disagrees with SUMMERSET decision on the allocation of reasonable adjustments or special consideration; • If a learner disagrees with the action taken against them following an investigation into malpractice; • If a learner believes there were errors with the question paper that impacted the result; Please note that SUMMERSET will not accept appeals if the only grounds are that the learner is unhappy or disappointed with the result.In these circumstances we suggest that the learner speak to their Training Provider to get feedback on areas where they could improve. If the learner is looking for their mark to be reviewed due to sickness or other extenuating circumstances that took place at the time of the examination, please see the Access Arrangements, Reasonable Adjustments and Special Considerations Policy.The learner can request a re-mark on failed written exams or where a Distinction grade was narrowly missed. Re-mark requests will not be accepted for any multiple-choice examinations as these are marked electronically.If the learner would like the Training Provider to act on their behalf, please ensure that the ATP have been given written permission to do so. The learner must submit notice of an appeal within 10 working days of the assessment/ examination result being released.Any appeals received after this date will be reviewed on a case by case basis and may be allowed to proceed if there are extenuating circumstances as to why the appeal was not submitted within the required timeframe.

Process for raising an Appeal

All appeals must be submitted in writing to admin@summerset.lk within 10 working days of the examination result date.SUMMERSET will acknowledge receipt of the appeal within 5 working days.The appeal details will be directed to the relevant team for an investigation to take place.

What details do I have to give?

When submitting an appeal please provide us with:• full name; • SUMMERSET registration number (if known); • examination date • examination title• details of the appeal;

How long will it take to review?

SUMMERSET will acknowledge receipt of the appeal within 5 working days, letting the learner know who will be investigating the appeal.The appeal will be investigated by someone who has no personal interest or involvement in the matter of the appeal.SUMMERSET will aim to provide the learner with the outcome of the appeal within 20 working days.Please note that in some cases the review processes may take longer, for example, if a Training Provider visit is required.If this is the case, we will contact the learner to let them know and provide the likely revised timescales.

Decision

The outcomes of any appeal against a decision may be either to uphold the appeal or to reject it.If we do not believe there is a valid case for the appeal the learner will be given the reasons for the decision.SUMMERSET will inform the learner of the decision in writing.

Independent Review

If the learner does not agree with the decision, then they have the right to a final independent review, this must be made within 15 working days of the decision.This will be carried out by someone who is not a SUMMERSET employee. The independent reviewer will also be someone with the relevant competence to decide in relation to the appeal. The Independent Reviewer may involve a further discussion with relevant parties involved in the appeal. The Independent Reviewer’s decision is final in relation to how SUMMERSET will consider such appeals and we will let the learner know the outcome of the review within 20 working days of receipt of the independent review request.If the learner is still unhappy with the outcome the learner is entitled to raise this directly with the relevant Regulator (this applies to regulated qualifications only)

Review Arrangements

SUMMERSET will review the policy annually as part of our self-evaluation arrangements and revise it as and when necessary, in response to customer and learner feedback or requests from, or good practice guidance issued by, the regulatory authorities.Anyone who wishes to provide feedback should send their comments to admin@summerset.lk.


 

Feedback & Complaints Policy

At SUMMERSET, we continuously seek opportunities to improve our processes and procedures so that we can continue to serve our students better and stay relevant. We value feedback from our students.

Feedback from students is most welcome. Students can forward their feedback to our Admin Counsellors or sent via email to: admin@summerset.lk

When Feedback is received from our students, SUMMERSET Management shall review them in earnest and existing processes and procedures will be streamlined, as appropriate.
Your feedback will be acknowledged by SUMMERSET within 2 working days. SUMMERSET will officially respond to your feedback and complaint within 21 working days.

In the event where the student and SUMMERSET are unable to resolve the issue, external mediation parties shall be sought.

Data Protection Statement

As an established and trusted private educational institution, SUMMERSET is committed to maintaining a high standard of confidentiality with respect to the personal data of our students, alumni, employees and associate lecturers in accordance with the requirements of the Personal Data Protection Act 9 of 2012 (the “PDPA”) in Sri Lanka

Introduction

 “Personal Data” is defined under the PDPA to mean personal information, whether true or not and whether in electronic or other form, about an individual who can be identified:

  1. from that data; or
  2. from that data and other information to which we have access to or are likely to have access to.

Examples of personal data are your name, address, NIC/Passport number, photograph or video image, telephone numbers and email addresses.

 

Purposes for Collection, Use & Disclosure of Personal Data

  1. SUMMERSET and its partners, including its University partners (collectively “SUMMERSET”, “we” or “us”) collect, use and disclose your personal data for the following purposes in connection with the products or services which you have applied for, to the extent applicable:
    • general administration of your application and/or registration and/or enquiry, including those personal data collected by our recruitment agents, for any programme offered by us or our University partners;
    • providing the student support and administrative services to you;
    • responding to any complaints, feedback, requests and enquiries by you;
    • disclosing your records to your parent(s) or guardian(s) at their request;
    • informing you of events, talks, seminars, surveys and updates;
    • conducting checks with the DO NOT CALL Registry;
    • maintaining and updating our student, alumni, and associate lecturer records;
    • generating financial, regulatory, management or survey reports and statistics for SUMMERSET’s business and administrative purposes;
    • meeting or complying with SUMMERSET’s and University partner’s internal policies and procedures and any applicable laws, rules, regulations, codes of practice or guidelines, orders or requests issued by any court, legal or regulatory bodies (including but not limited to disclosures to regulatory bodies, conducting audit checks, surveillance and investigation;
    • preventing, detecting and investigating crime, offences or breaches including that related to the security of SUMMERSET’s premises (including but not limited to the use of security cameras);
    • purposes which are reasonably related to the above.
  2. By providing the Personal Data, including those related to a third party (e.g.: information of your parents) to us through the various channels (e.g.: written form, webpage), you represent and warrant that consent, including that of the third party, has been obtained for collection, use and disclosure of the Personal Data for the respective purposes. In the event the personal data is to be used for a new purpose, SUMMERSET will notify you and seek your consent.
  3. SUMMERSET ensures that your Personal Data held by us shall be kept confidential. When transferring personal data to our third-party service providers, agents and/or our affiliates or related corporations whether in Sri Lanka or elsewhere to carry out one or more of the purposes listed above, we will require them to ensure that your Personal Data disclosed to them is kept confidential and secure.

 

Withdrawal of Consent

  1. Associate Lecturers and students may withdraw your consent to any or all use of Personal Data for any or all of the purposes set out in this policy in writing and submitting through our email or through our Reception counter in either of SUMMERSET campuses. For alumni, you may “unsubscribe” to the relevant notifications from Alumni Engagement.
    Without prejudice, if you withdraw your consent to the use of your Personal Data for any or all purposes, depending on the nature of your request, SUMMERSET may not be in a position to continue to provide our services to you or administer any contractual relationship in place, in which case SUMMERSET reserves the right to cease providing the services and/or terminate the contractual relationship with you.
  2. Without prejudice to the foregoing, you agree and acknowledge that any withdrawal of your consents in accordance with the terms set out in this notice will not affect any consent which you may have provided to SUMMERSET in respect of the use of your Sri Lanka telephone number(s) & your email for the receiving of marketing or promotional information.


Administration & Management of Personal Data

  1. As SUMMERSET relies on your Personal Data to provide services to you, you shall ensure that at all times the information provided by you to us are correct, accurate and complete. Student shall update us in a timely manner of all changes to the information provided via email.  Alumni and Associate lecturers shall update their Personal Data through our relevant departments as and when necessary or through our annual update.
  2. You can view your personal data which SUMMERSET has collected and stored at any time. To do so, you will need to submit your request via email to the relevant Campuses to view your personal data residing with SUMMERSET. Your right to view your personal data is limited to your personal data only.  SUMMERSET is not permitted to reveal any personal data about any other individual. SUMMERSET reserves the right to refuse access to your personal data if it will reveal or lead to the revelation of another individual’s personal data, cause harm to you or another individual or is contrary to the national interest.
  3. Your Personal Data is retained to the extent one or more of the purposes for which it was collected remains valid and/or for other legal or business purposes for which retention may be necessary.
  4. SUMMERSET will take commercially reasonable efforts to take appropriate precautions and preventive measures to ensure that the electronic storage and transmission of your Personal Data is adequately protected and secured with the appropriate security arrangements and that our data intermediary are aware of the requirements of PDPA. However, we cannot assume responsibility for any unauthorised use of your Personal Data by third parties which are wholly attributable to factors beyond our control.
  5. SUMMERSET reserves the right to amend this Policy with or without notice from time to time.

Please note that this Policy does not derogate from the terms and conditions governing your relationship with SUMMERSET and its related corporations. SUMMERSET’s rights under this Policy shall be without prejudice to other rights of collection, use and disclosure available pursuant to the terms and conditions or under the law and nothing herein is to be construed as limiting any of these other rights.
